Within the school as a learning support assistant I have a duty of care to the children. I need to ensure that the children are in a safe environment and that they feel happy in that environment.

I have a duty of care to report any concerns I have about a child, that may come from there home situation. This must be reported immediately to the classroom practitioner and Child Protection Officer (CPO) within the school. It is important when looking at conflicts and dilemmas within the setting to ensure that you have got all the information possible to ensure the right cause of action. However even with all this evidence in place it is important that more than one person makes the decision and actions needed. For example, if a child discloses something to a member of staff and requests that it is kept confidential it is important to initially inform the child that it may have to be passed on, at this point you should risk assess the situation and decide whether the child is in harm or not. However within the school setting you also have a duty of care to the children, so it is important any important information that is disclosed to yourself if you feel it necessary then to inform another member of staff. For example the class teacher, line manager or child protection officer.
3Explain where to get additional support and advice about conflicts and dilemmas
Within the school there will be a support network of people to get support and advice on conflict and dilemmas these may include, the head teacher, child protection officer or line manager. Further information and advice will be available from the local authority. However there will be other outside agencies that can offer support for such things, these include; Children rights being available on the UNICEF website, right to include children with disabilities can be found on the contact a family website. There are also many websites available when conflicts and dilemmas arise with disabilities and impairments which includes the NHS clinical knowledge summary and the NHS encyclopedia website.
The way in which complaints should be dealt with is that you should remain calm and if a person is making a complaint in front of other parents, ask whether they would step into a more private area, however if possible try to have another member of staff present. If possible try to make written notes during it and explain to the person who is making the complaint that you are making notes in order to pass information onto a senior member of staff within the school. If it is not possible to make written notes then you should make mental notes and after then meeting write everything down. If the issue needs to be addressed there and then you should find the appropriate person to deal with it. If the issue is less urgent then you could say to the person that you will speak to the appropriate member of staff and that they will get in contact with them as soon as possible. Thank them for there concerns and pass on the information.

2.Explain the main points of agreed procedures for handling complaints
Within the school a policy has been compiled in order to deal with complaints. There are 3 stages in which a complaint will be dealt with. Stage one, is the first step in dealing with a complaint, the complaint will be raised and possibly be resolved immediately by the class teacher, however they may feel it needs to be referred to the Deputy head teacher or the Head Teacher using there professional judgment. At this point the complaint may be in writing or may be oral. Stage 2 is where the matter is referred to the Head Teacher in writing for an investigation, decision and resolution. It is suggested that there is a target date in which the complaint will be resolved, this usually is 10 days. The head teacher may ask another member of staff to investigate the complaint however during the whole process the head teacher must be kept informed.
The head teacher should keep a record of the complaint at stage 2 and ensure all documentation is kept with regards to responses. Stage 3 is the final stage in which the complaint will be raised on a school level; this is where the matter is passed to the governing body in writing for their investigation. If there is anyone still not satisfied they may write to the chair of the governing body. The clerk to the governing body within 15 days usually, will have convened a committee of 3 governors to hear the case of the complaint.
The complaint will then be informed within writing in 3 school days. There is one additional stage to which the complainants may take if they unhappy with the process that has been taken in order to resolve the complaint. This would involve taking it to the Welsh Assembly. The purpose of their involvement would be to act as an independent investigating body to review the stages of the complaint that has previously been taken, however they are not there to review the decision itself. Formal complaints within stage 3 will be taken back to the governing body on a termly basis, the Head teacher along with support from the governing body is responsible to ensure that this policy is implemente
