She tells me it is her best friend’s boyfriend’s picture that he has sent to her best friend who in turn sent it to my all too curious, naive daughter.
I wonder if I tell her that if caught prosecuted and convicted she would be the popular high school sex offender and the only felon on the high school cheerleading squad. While there certainly should be punishment for teens that send explicit pictures on their telephones, treating them like pedophiles or hardened sex offenders goes too far. The laws are strict and different in each county. Teenagers under age 18 who photograph and send images of their own bodies in nude, sexualized poses can be charged with production and distribution of child pornography.
Anyone to whom they send those images can be charged with possession of child pornography, even if the sender of the image wanted them to have it. The age of consent is 16. This means a 16-year-old girl can legally have sex with her boyfriend (or girlfriend) but if she films it, or if she photographs her own breasts and sends that image to her partner, she can be prosecuted. How can a person be charged for photographing their own body? And how can they be considered both the victim and the perpetrator of the same crime?
These teens are our neighbors, our kid’s, and they work in our community. Once my daughter is a convicted sex offender it will jeopardize her future. The path she was supposed to take will be closed, for good. Child pornography laws were put in place to protect children, not to criminalize teenage sexuality. And what good can come from grouping sexually curious teenagers in with convicted gang rapists and pedophiles? If a picture stays between the taker and its recipient there is no reason to prosecute.
If prosecution is necessary there should be different punishments on a case by case basis. Not only does this ruin their lives unnecessarily, but it also undermines the power and authority of the sex offender register.
