The Survival of Moral Federalism” by Kimberly Hendrickson Political science and the political forecasts are very exciting kinds of science. Some of them may become futile and the most nonsensical theories may come try. Only the time can show which of them have sense. Law professor Robert Nagel researched law and policy for many years. His recently released book The Implosion of American Federalism states that American federalism is dead, or at least doomed to irrelevance.(The Survival of Moral Federalism) The article I want to summarize is totally and through dedicated to Robert Nagels book on American federalism, its chances for existence and interesting points of view. In the end of the paper I will try to give you my own point of view based on this article and I will try to persuasive. We already stated that the book of Robert Nagel gives no chances for Moral Federalism.
The era of small government is over, he writes, and the nanny state in full swing. Ours is a politics of nationalized intimacy (The Survival of Moral Federalism) He also unmasks popular public opinion that judges, lawyers, and law professors deserve a starring role in the political process or among the nation’s intellectual elite. He notes the damage “lawyerthink” has done to deliberative democracy, cultural norms, and above all, federalism. (The Survival of Moral Federalism).
In The Implosion of American Federalism we also get a clear conception of what the moral federalism is. He outlined the main features and gives some concrete examples.
The Essay on Federalism in the American System
There is much mentioned about “states rights” in the political process, but while many have heard of the term, they may not exactly understand what states rights refers to. In order to understand the term states rights, one needs to understand the term federalism. From a clear understanding of what federalism actually is, one can draw a sharp conclusion as to what the relationship between the ...
In the past decade, Alaska, California, Colorado, Hawaii, Maine, Nevada, Oregon, and Washington have all passed medical-marijuana laws thanks to citizen initiatives. Likewise, citizens in Maine, California, Oregon, Washington, and Michigan have voted on assisted-suicide measures. (Kimberly Hendrickson) Then we are acquainted with concept of moral politics, and its conceptive and modern schools. Religion is represented as the basis for the old school. This union between religion and politics was the essence of local regulation: Religion directed the customs of the community and thereby shaped the laws of the state. (The Survival of Moral Federalism) Liberation laws are the part of new moral school.
For example, euthanasia is considered to be a moral good because it validates the right to die and individual preference. (Kimberly Hendrickson).
Interesting is the blue and red map which shows us that inhabitants of big cities overwhelmingly vote Democratic, while those who live in small towns are mainly Republican. The religion also plays a good role in voters tastes. Kimberly Hendrickson outlines that some odds in the moral regionalism must be revised. According to Justice Douglas “The chronicles are filled with sad attempts of government to stomp out ideas, to ban thoughts because they are heretical or obnoxious.” Local morality, one would think, didn’t stand a chance, when pitted against progressive national standards. (Kimberly Hendrickson).
In the end of the article Kimberly Hendrickson states that restraining of moral laws is a good news for America but we it still need some restraining for liberating morals law. I dont believe that there is room for significant moral diversity among and between the states. If there were some doubts they were dispelled by this article. It provides information very clearly and openly. Moral is strongly based on the religion and other beliefs, traditions, customs and peoples own way of evolution. Surrounding and community opinion is also a part of a moral.
So it is that all this moral foundations are much the same for all the states. However, I think, that on some point moral diversity among and between the states can be distinguished if somehow the moral principles changed. Some great upheaval or isolation can a good become ground for social disruptions. There are no hints for catastrophes, which can change society in the nearest future. In other words we can sleep peacefully because there are no threats for our morality. But only the time will tell who is right and who is not.
