Child Pornorgraphy Modern time is considered to be a time of high moral value. But this statement sounds improbably taking into account the existence and distribution of child pornography. The problem has been regarded as international one. The global community has supported the decision of the United Nations Convention on the Rights of the Child (“UNCRC”) to take measures against child pornography. It should be said that the debates about the problem is rather controversial. First of all, there are several definitions of child pornography. It has happened because different countries have different definitions as to the age of child and the meaning of pornography.
According to The Council of Europe definition, child pornography is “any audiovisual material which uses children in a sexual context.” (Recommendation R (91)11, 1993) But in some countries, such as the United States, the definition child pornography is based on harm that has been made and states: “the permanent record of the sexual abuse or exploitation of an actual child.” (Lanning, supra note 3, at 24) Child pornography was widely spread in developing countries among street children, poor children, juveniles from broken homes, and disabled minors. Poverty, illiteracy, hunger, and disease were the main reasons for it. Among child exploiters and pornographers there are a lot of highly esteemed members, photographers, publishers and creators of home videos, advertisers and even parents. Nowadays, the wide use of computers and on-line communication has provoked new wave of child pornography. As a rule, producers and consumers have no sexual preference for children. Thats why there are a lot of controversial points of view: if they are guilty or not. Most of all, the image may be created in the country where it is legal and traveled to another country where it is illegal. Which side should be considered guilty? Child pornography, spread with computers, has produced a lot of additional legal issues.
